DMCA Policy

EFFECTIVE MAY 11, 2026

Noirchive respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to notices of alleged copyright infringement reported to our designated Copyright Agent.

1. Filing a DMCA Takedown Notice

If you believe that content on the Noirchive Service infringes your copyright, please send a written notice that includes all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are covered by a single notice, a representative list).
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with information reasonably sufficient to permit us to locate it (e.g., URL, screenshot, fit ID, username).
  4. Your contact information — name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Counter-Notice

If your content was removed in response to a DMCA notice and you believe the removal was a mistake or that you have the right to post the content, you may file a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the U.S., for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original notice or an agent of such person.

3. Repeat Infringers

We will, in appropriate circumstances and at our sole discretion, terminate the accounts of users determined to be repeat infringers.

4. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents in a notice or counter-notice that material is infringing or was removed by mistake may be liable for damages. Do not make false claims.
